Kitwe couple jailed for assault
ACOUPLE has been sentenced to prison while their two teenage children have been discharged for assault after a fight between two families.
Magistrate Maureen Nkonde sentenced Benjamin Chabala 38 to five months simple imprisonment while his 34-year-old wife Agnes Kaluba will serve three months. The Chabala family was charged with one count of assault. On December 2 last year the couple, son and daughter did assault Carol Mwango, thereby occasioning her actual bodily harm. The magistrate said the prosecution had proved the case against the four and convicted them accordingly. Meanwhile, the Probation Officer Changa Chumba made a recommendation before the court that the two juveniles should be discharged as none of them seemed to be unruly. Ms Chumba said the 15-year- old girl was a Grade 11 pupil while the boy was 16 and a Grade 12 pupil adding that the two teens were not unruly. She said what happened between the two families was unfortunate and it did not only affect the victims and her family but the Chabala family too. Ms Chumba the husband and wife were first offenders and recommended that the court enters an absolute discharge for the two teenagers. Meanwhile Chabala pleaded for forgiveness in his mitigation and that he was the bread winner of his family and if sent to prison his family would suffer. The magistrate however observed that the couple had followed the victim to her house and therefore sentenced Chabala to five months and Kaluba to three months simple imprisonment.
