Mujajati seeks default judgement

Dr Mujajati wants the court to enter judgement in default of appearance and defence because neither Dr Chilufya nor the Attorney General have entered defence in the matter.

FORMER Registrar of the Health Profession­als Council of Zambia (HPCZ) Aaron Mujajati has asked the Lusaka High Court to enter a judgement in his favour in a matter where he sued Minister of Health Chitalu Chilufya and Attorney General Likando Kalaluka for defamation of character.

Dr Mujajati wants the court to enter judgement in default of appearance and defence because neither Dr Chilufya nor the Attorney General have entered defence in the matter.

This is in a matter in which Dr Mujajati sued Dr Chilufya and the State seeking damages for defamation of character after they allegedly accused him of being irrational and inhuman for closing down health institutio­ns on flimsy grounds.

Dr. Mujajati also wants the court to grant him an injunction restrainin­g Dr. Chilufya from issuing further defamatory words.

Mr. Morris Lungu an advocate of Messrs Mulengeshi and Company legal practition­ers stated in an affidavit in summons to enter judgement in default of appearance and defence that 14 days had elapsed since the matter was commenced and served on the defendant but they had not responded.

"The matter was commenced by way of writ of summons and statement of claim against the first and second defendant on May 24, 2019 and was served on the defendants the same day.

"The defendants have not entered an appearance nor filed a defence to the writ of summons and statement of claim and the 14 days within which they were required to do so has since elapsed," Mr Lungu said.

He stated that on these premises he was applying for leave to enter judgement in default of appearance and defence in the matter.
