Money Lender seeks judgement against Deka
A MONEY lending company has asked the Lusaka High Court to enter judgment on admission in a matter it is claiming K2.6 million from Policy Monitoring and Research Centre Executive Director, Bernadette Deka.
In this matter Vyansilati Enterprises Limited is seeking an order that Deka pays back the K2, 675,000.00 owed to it at 15 percent interest per week from the date of default being April 27, 2019.
ccording to an affidavit in
support of summons for an order to enter judgment on admission, Mr Harold Chibwe, a director of Vyansilati said on April 12, 2019 the company entered into a loan agreement with Deka for K2.6m.
He said it was to be paid within two weeks and late payment attracted a penalty of 15 percent of the total payment amount.
Mr Chibwe said on May 23,
the company’s advocates
issued a letter of demand for K4.5m that was duly acknowledged by Deka on May 29, 2019.
He said Deka through a letter admitted owing the Vyansilati K2.6m and made an undertaking to settle the amount.

advising her to pay the admitted sum of K2.6mwithin two weeks from the date of the
defendant’s letter and thereafter
interest would be re-negotiated.
In her defence Deka denied owing the Vyansilati Enterprises limited K2.6 million stating that her agent Peter Malawo entered into an agreement with Marvin Chibwe to borrow a sum of K1, 000, 000 on January 18, 2019.
