Yamba, 5 others face corrupt practices charges
“We have made changes and added more charges as we jointly charged the accused persons,”’ the prosecution said.
The state applied that Yamba, Mugemezulu, Patrick Nkanza, Joseph Nthele, Joseph Phiri and Joseph Ngulube be jointly charged.
Allegations in count one are that Yamba, on dates unknown but between January 1, 2017 and December 31, 2017, in Lusaka being Secretary to the Treasury in the Ministry of Finance, did willfully fail to comply with applicable law or procedure relating to the management of funds in authorising an advance payment of $33m to China Energy Engineering Group Human Electric Power Design Institute Company Limited for the construction of FJT Chiluba University under the Ministry of Higher Education.
The second count states that Zulu, on dates unknown but between January 1, 2017 and December 31, 2017 in Lusaka, as Permanent Secretary in the Ministry of Higher Education, willfully failed to comply with applicable law or procedure relating to procurement in entering into a contract with China Energy Engineering Group-Human Electric Power Design Institute Company Limited worth K225 million for the design and building of FJT Chiluba University without subjecting the said contract to Zambia Public Procurement Authority (ZPPA) for approval.
Details in count three are that that Nkanza on dates unknown but between January 1, 2015 and December 31, 2015, in Lusaka being Permanent Secretary in the Ministry of Education, Vocational Training Science and Early Education, willfully failed to comply with applicable law or procedure relating to procurement in entering into a contract with China Energy Engineering Group-Human Electric Power Design Institute Company Limited worth K213, 734, 967.77 without confirming the availability of funds.
