CONCOURT UPHOLDS MUNDUBILE ELECTION AS MP
THE Constitutional Court has upheld the election of Mr Brian Mundubile as Mporokoso Member of Parliament on the Patriotic Front ticket.
This is according to a judge ment delivered yesterday by Constitutional Court depu ty president Judge Professor Margaret Munalula.
The court dismissed the appeal by UPND losing Mporokoso Parliamentary candidate, John Sampa, in which he challenged the High Court’s declaration that Mr Mundubile was duly elected.
The ConCourt dismissed the appeal on account that Mr Sampa had failed to provide enough evidence that the al leged malpractices affected the outcome of the elections held on August 12, 2021.
Among the six grounds of appeal, Mr Sampa contend ed that the lower court erred in law having held that the discharge of a firearm aimed at him during the elections on August 12, 2021 had no bear ing on the voting process and outcome of the polls.
He named Mr Wilbroad Musonda as Mr Mundubile’s agent who pulled the trigger on the material day.
According to the findings of the lower court, the alleged shooting incident happened at around 20:00 hours when vot ing had already closed.
