Lawyer accrues $9k in home rentals

WOES continue to mount for prominent Bulawayo lawyer, Mr Brighton Ndove after his property was attached over rent arrears and outstandin­g utility bills of over $9 000.

His landlady approached the courts after he failed to pay rentals and utility bills since 2013 for a house he is renting in Burnside suburb.

The lawyer, who is a senior partner at Ndove, Museta and Partners, had his four motor vehicles, a Mazda Familia, Ford truck, Toyota sedan and a Nissan Sedan attached by the Messenger of Court last week.

The attached property is set to be sold by public auction on January 20 next year.

The attachment came following a judgement by Bulawayo magistrate Mr Sheunesu Matova at the civil court.

“Judgement is hereby entered for the plaintiff as claimed in the summons on the default of defendant at trial,” ruled Mr Matova.

According to court papers Mr Ndove’s landlady, Ms Tracy Moyo claims he owes her $9 504 in rent arrears as well as outstandin­g water and telephone bills dating back to 2013.

Ms Moyo through her lawyers Sansole and Senda legal practition­ers, argues that sometime in 2011 she entered into a lease agreement with Mr Ndove for a house at number 94 Burnside Road.

“Under the agreement, defendant was to pay $500 monthly as rent and would be responsibl­e for rates, water, sewage charges, electricit­y and telephone as they fell due,” read the summons.

Ms Moyo claims that Mr Ndove breached the agreement as he failed to pay rentals and other utility bills.

“In particular, the defendant has not adequately paid rentals for the months of October 2013, November 2013, January to August 2014 accumulati­ng a debt of $5 500.

Of the total debt, Ms Moyo claims, the lawyer paid $1 300, leaving a balance of $4 200, but also did not pay rentals for the month of September 2014, leaving the total due at $4 700,” read the summons.

Mr Ndove is also said to have accumulate­d a debt of $4 439 in unpaid water bills and rates, and $365 in unpaid telephone bills at the property in question.

In October he was taken to court on charges of fraud involving forgery of title deeds and selling of a property without the owner’s knowledge and consent. He was however granted refusal of further remand after he successful­ly challenged the State’s allegation­s. @AuxiliaK.
