ACCUSED RAPIST’S TEXT MESSAGES REVEALED:
COURT TOLD: Drunk woman allegedly attacked by friend
A MAN is accused of raping his female friend after a drunken night out in Geelong.
Police allege the single father had non-consensual sex with the woman and digitally raped her after the pair went bar-hopping with another friend in December 2017.
The Geelong County Court heard the alleged incidents happened at a home in Bell Post Hill after the trio attended popular local nightspots, including Beav’s Bar, Lambys and Home House.
The alleged offender — who cannot be named for legal reasons — has pleaded not guilty to five charges, including attempted rape and two counts each of rape and sexual assault.
At the opening of a trial yesterday, Crown prosecutor Nick Batten said it would be alleged that the complainant was trying to sleep — due to being drunk and tired — when the man had sex with her during the morning of December 16, 2017.
“She was not in a state to say or do anything more, I expect her evidence to be,” Mr Batten told a 12-person jury. He said the woman had previously made it clear to the accused rapist that she was not interested in forming an intimate relationship with him.
However, the defendant has claimed the woman was “flirtatious” with him on the morning of the incident and he believed she was “fine” with sexual interaction.
A series of texts were read to the jury, including one sent by the man soon after he left the woman’s home.
“Hey love, I’m sorry if I upset you … I had an amazing night out with you,” it read.
“It was nice to cuddle up with someone I care about x.”
After she did not respond to his messages, the man sent a further text stating: “I thought you were interested. Obviously I was wrong and f---ed up again.”
The woman reported the matter to the police later that day. Mr Batten said it would be argued that the man would have been “well aware” the woman was in a drunk and tired state that meant she was incapable of consenting to sex.
