Fatal driver’s drug charges

A DRIVER who struck and killed a Winchelsea teenager will fight a drug-driving charge stemming from the night of the crash.

Billy-Jay Glynn was acquitted earlier this year of dangerous driving causing death and failing to render assistance over the death of 18-year-old Tyler Dean. But the 23-yearold continues to face a drugdrivin­g charge that did not form part of his County Court trial.

Mr Dean was killed almost instantly when he was struck head-on while riding a motorised pushbike along Atkins Rd, Buckley, late on October 18, 2017. During his trial, a lawyer for Mr Glynn argued the Winchelsea man believed he had hit a kangaroo when he decided to drive away from the scene.

Yesterday, the Geelong Magistrate­s’ Court heard Mr Glynn was allegedly detected with cannabis in his system when police took a sample from him in the hours after the fatal collision.

Defence lawyer Simon Northeast said his client would contest the charge and asked for the case to be adjourned to a contested hearing.

John Weigl, for the Office of Public Prosecutio­ns, said there seemed to be a “clear issue” of whether Mr Glynn consumed cannabis before or after the incident.

Director Christian Cavallo said the cast was predominan­tly from Geelong and had been rehearsing since the start of July.

“Audiences can expect a reonment and Mr Glynn can only be fined if found guilty.

Magistrate Ross Maxted scheduled the hearing for January, saying the matter needed to be finalised promptly.

“For these people involved in this case, it might be stressful for them, so the quicker this is dealt with, the better,” he said.

The prosecutio­n is set to call four witnesses at the hearing, including Mr Glynn’s partner, while the accused will give evidence in his defence alongside his mother.

A special mention has been scheduled for December 18, before a 1½- day hearing on January 30 and 31.

Mr Glynn, who was supported in court by his mother, had his bail extended until the next court appearance.
