Sentencing delayed after illness claims
THE sentencing of a Geelong man who injected heroin into a 14-year-old girl has been delayed after he failed to appear in court.
Michael “Noddy” Timms, 61, was due to be sentenced on Thursday for a series of crimes involving the teenage victim.
But the case has been pushed back to next month after Timms was a no-show.
The County Court previously heard Timms had been diagnosed with liver cancer.
His lawyer speculated on
Thursday that his non-appearance could be linked to his health.
“It may well be that he’s very unwell,” defence barrister Sandra Wendlandt said.
Timms is on bail after spending 16 months locked up for offending that took place in 2016 inside a Malop Street squat house.
Court documents reveal Timms preyed on his teenage victim after regularly supplying her with a range of illicit drugs.
It started when Timms, who was homeless at the time, injected the girl with heroin.
After she turned 15, the victim spent a week with Timms while listed as a missing person.
During their week together, Timms regularly supplied the girl with methamphetamine and cannabis.
On one occasion, while the girl was drug-affected, Timms groped her breast while masturbating.
The incidents were reported to police in mid-2018, leading to Timms’ arrest during a raid on a separate squat on Bellerine Street.
Timms pleaded guilty earlier this year to two charges of supplying a drug of dependence to a child, and one count of indecent act with or in the presence of a child under 16.
Judge Gerard Mullaly previously indicated his likely sentence would be imprisonment of time served, along with a community correction order.
The judge on Thursday said Timms’ failure to appear in court was unfortunate, but he accepted it could be linked to deteriorating health.
The prosecution did not seek a warrant for Timms’ arrest. A sentencing hearing has been scheduled for November 9.
