Man hurt in brawl denies he had a gun

- HELEN KEMPTON

ONE of the two men hospitalised after a fight in Railton’s main street has denied he was carrying a gun at the time and had threatened to shoot the two men now on trial in the Supreme Court in Burnie.

Daniel Richard Jago and Adam Chris Onions have pleaded not guilty to two counts of committing an unlawful act intended to cause bodily harm in relation to the street brawl on November 17 last year.

The fight involved baseball bats and axes, with Graeme Titley and another man taken to hospital after the violent public incident

Mr Titley, 58, who appeared as a witness, told the court he had travelled to Railton from his home in Weegena on the day in question to look at the goods in his son’s second hand shop before it was closed down.

He told the court while he was at the shop, a car pulled up out the front and the people inside it were yelling abuse.

Mr Titley said he was unsure what the issue was about but he heard his surname mentioned.

When the car drove off, he followed it and arrived at a property he knew only as “the Jago house”.

Mr Titley said he intended to tell the occupants to stop the abuse or he would involve the police.

Mr Titley said he returned to the shop and was about to enter when “the lights went out and I woke up I hospital”.

Footage from a CCTV cam- era in the street was played to the jury and two men could be seen kicking and hitting Mr Titley while he was on the ground.

Under cross examination, Mr Titley denied he was looking for a fight, swerved his car at a woman at the Jago property and threw a stubbie of beer. A broken stubbie was found at the house matching others seen in Mr Titley’s car in photographs.

Mr Titley also denied having a sawn-off firearm down his pants on the day of the violence and that he had shown it to the two men charged over his injuries and threatened to shoot them

“I don’t own a firearm now and I did not then,” Mr Titley said.

The trial continues.
