-

A SOUTHERN Tasmanian man sent more than 100 text messages and called a woman more than 70 times before sending explicit images of her to another man after she declined a dinner invitation, the Supreme Court in Hobart has heard.

Andrew David Gilley, 45, of Midway Point, has pleaded guilty to two counts of using a carriage service to menace, LORETTA LO LOHBERGER LO harass or cause offence.

The court heard Gilley and the woman had been in a relationship for about a year after meeting at a gym, but broke up in November 2016, after which they had an “on again” relationship.

Commonwealth prosecutor Jessie Sawyer said on March 11 last year, Gilley asked his expartner out to dinner and the movies but she declined.

He then sent her more than 100 text messages, tried to call her more than 70 times, and sent her six video messages on social media.

Ms Sawyer said the videos, again, off that the woman recorded using a friend’s mobile phone, were abusive, and Gilley threatened that the father of her children, “gets the f...ing kids”.

Defence lawyer Fabiano Cangelosi said his client accepted the messages became aggressive towards the end.

Ms Sawyer said Gilley also sent five “extremely intimate and explicit images” of the woman to children.

Mr Cangelosi said before Gilley sent the images, he had argued via online messages with the other man who accused Gilley of being “toxic” for the woman.

He said Gilley sent the images as part of his argument that he had been good for the woman, partly because he encouraged her at the gym. the father of her

“The purpose of sending the explicit images … was not that he was going to embarrass her,” Mr Cangelosi said.

“It was to show … the effect of working out at the gym … that was what was in his mind.”

Gilley realised that what he had done was “absolutely stupid”, Mr Cangelosi said.

Justice Robert Pearce will continue hearing sentencing submissions today.
