No jail after sex assault

A WOREE man has been warned to keep his hands to himself after he sexually assaulted two women.

“It is extremely disturbing that because you were horny you thought it was appropriat­e to touch (those women),” Magistrate Kerry Magee said.

Timothy Pablo, 31, was riding his bike on Spence St when he passed the first victim, 30, on September 15.

The Cairns Magistrate­s Court was told Pablo circled back and groped the woman’s bottom and legs as he rode by.

On September 21, Pablo committed a similar offence against a 31-year-old woman on Anderson St.

“It is an extremely serious violation of a woman’s right to privacy,” Ms Magee said.

“It must have been extremely disturbing and discomfort­ing for the women victims of your behaviour.”

Neither woman was physically injured.

Pablo was charged last week and pleaded guilty yesterday to two counts of sexual assault and an unrelated charge of driving without a licence as a repeat offender.

Police prosecutor Senior Constable Amy Rennie said Pablo had no history of similar offences.

Aboriginal and Torres Strait Islander Legal Services solicitor Steve Carter said his client was not working and received fortnightl­y unemployme­nt benefits.

“My client is well aware of the seriousnes­s of the charges,” Mr Carter said.

He argued for probation with a special considerat­ion for sexual offending, on top of a suspended jail term, to reflect the serious nature of the offences and to ensure Pablo received the help he needed.

Ms Magee agreed and said the only reason Pablo would be released immediatel­y was because the offences did not involve violence.

She jailed Pablo for three months, wholly suspended, and placed him on 12 months probation.

Conviction­s were recorded against Pablo.

Ms Magee left Pablo with three pieces of advice before he left the courtroom.

“Keep your hands to yourself, show respect for women you come in contact with and do not touch them unless you are invited,” she said.
