COP FACES RAPE TRIAL

A CAIRNS police officer accused of raping and choking a woman he met online apologised to her several times afterwards for his behaviour, a court has heard.

Kurt Alexander Nesterowic­h was in the District Court in Brisbane yesterday where he pleaded not guilty to two charges of rape, one of sexual assault and one of common assault.

The jury was told he twice raped the woman and choked her three times, then apologised to her, firstly by text just minutes after the alleged rape in the early hours of April 16, 2016, then again later that day in a “pretext call” set up by police.

Crown Prosecutor Matthew Hynes told the jury that the woman was raped in her own bed after she agreed he could come to her home and “cuddle” after he had been out drinking with his mates.

Mr Hynes said she was clear about her intentions, texting him: “R U coming over for sleep or expecting booty because I’m telling you no sex will be had,” the woman texted the officer.

“I’m not after sex, cuddles would be perfect though,” he replied.

She agreed to spoon with him in her bed, as long as he agreed to keep his clothes on, but told police that within minutes he digitally raped her and “got aggressive and scary”, choking her three times and grabbing her breasts, then refusing to leave her home.

She told police the first time he choked her it “wasn’t too forceful, it was probably what he would have been considered a sexual choke” but the second time he choked her it lasted five seconds and was “more forceful, quite tight across the front of my throat”.

“At that point I became very aggressive, and very ‘this is not what I want’. I said no repeatedly ‘let go of me’.

“He then apologised and said that he assumed that’s what I wanted for him, choking and sexual thing ... that I would liked to be choked ...”

A police spokesman said Nesterowic­h was posted to the Far Northern region and had been suspended from duties.
