Bail in joy ride case
THE White Rock mother of a 13-month-old boy who died from unknown causes has reappeared in court after being arrested on Boxing Day for allegedly joy-riding in a stolen car.
Defence solicitor Peter Haasma said Lina Marie Daley had been going through a “stressful time” following the death of Makavelii in September.
The 20-year-old mum is facing five charges including unlawful use of a motor vehicle and two counts each of stealing and driving with a licence that was demerit point suspended.
The Cairns Magistrate Court heard that Ms Daley was already on bail for other driving offences.
“Given her very limited history … it would be unjust to remand her in custody,” Mr Haasma said during a bail application yesterday morning.
“She also did suffer a considerable tragedy where a baby of hers passed away in very unfortunate circumstances.”
Acting Magistrate Scott Luxton said there were some concerning developments in relation to Ms Daley’s alleged offending behaviour.
“The concern is obviously there seems to be an escalation in terms of the offending and its seriousness,” Magistrate Luxton said.
“The evidence with respect to these matters is strong; it seems most if not all of the offending has been verified by CCTV footage.
“Even on a worst-case scenario … I cannot be satisfied that an order for imprisonment would be made,” Magistrate Luxton said.
Ms Daley was granted bail on residential conditions.
A co-accused for the unlawful use of a motor vehicle charge, Jake Hesterman, also appeared in court yesterday.
During his bail application the court heard that a car had allegedly been given to him on Boxing Day and that he knew it was stolen.
The court heard the car had only been in his possession for about two hours.
Mr Hesterman was also released on bail on residential as well as twice weekly reporting conditions.
The court heard that he and Ms Daley were also not allowed to make contact while on bail.
The case for Ms Daley was adjourned to January 17.
To keep them apart Mr Hesterman’s matters were adjourned to January 18.
