Bogged down feeling

IN WHAT a defence solicitor described as something out of the Benny Hill Show, a group of offenders had stolen vehicles which ultimately proved no get-away car when they bogged.

Bryton Paul Delaney had received a call from his sister at a Brookstead property on March 15 asking him to pick her up, Toowoomba Magistrate­s Court heard.

Delaney, 25, arrived in a stolen vehicle which got bogged on a dirt road on the property after heavy rainfall.

He had then become involved in a fight with the occupant of the property who he punched a number of times, the court heard.

Delaney called a friend to help get his car out of the mud, only for the second car to become bogged as well.

When the property occupant refused to use a tractor to tow the cars out, Delaney had again assaulted him.

Delaney and his three friends had then taken two quad bikes from the property only for both bikes to become bogged not far from the two bogged cars, the court heard.

They had then walked to the next property where they stole another vehicle.

Delaney appeared by prison video link to plead guilty to a range of charges including unlawful use of motor vehicles and to eight times using a stolen credit card.

The court heard Delaney’s offending started just weeks after being released from prison on parole and he was now serving out that term.

His solicitor Brad Skuse said drug use was behind his client’s offending.

Magistrate Kay Ryan sentenced Delaney to 15 months in jail but ordered he be eligible to apply for release on parole as of November 9.
