Man fined for breach

A MAN’S failure to control his anger after his partner took out a domestic violence order against him saw him fined and cautioned by a city magistrate.

Prosecutor Tim Hutton said police patrolling the CBD on June 10 saw the man and woman swearing at and abusing each other on Margaret St.

The pair had gone to a number of licensed venues and police watched the man get in then back out of a cab on the street in an effort to get away from the woman.

Checks found the man was the respondent to a domestic violence order, Sergeant Hutton said.

The man cannot be named for legal reasons.

The man pleaded guilty to contraveni­ng a domestic violence order, and breach of bail condition for failing to report to police on June 19.

The man spent Monday night in police custody on the charge.

Solicitor Kevin Rose said his client, 30, had taken steps to control his anger after the woman was granted the order in respect to breaching it.

Mr Rose further submitted his client worked long hours and on the day he was due to report to police had fallen asleep after finishing work.

Magistrate Catherine Pirie accepted the submission a fine was appropriat­e for the breach of domestic violence order and ordered the man pay $400, with a conviction recorded.

She said the time the man had spent in police custody on the breach of bail charge was penalty enough, and ordered he be released.
