Man cops jail term on mum’s invitation

A 29-YEAR-OLD man who on his mother’s invitation went to her house for a few drinks ended up spending the night in the watch house and copping a four-month jail term.

The man was prohibited from going to the Withcott home of his mother because her partner had a domestic violence order against him which included no contact between the two men, Toowoomba Magistrate­s Court heard.

However, when his mother invited him around on Tuesday night this week, the 29-year-old accepted the invitation.

When his mother’s partner arrived home later that night and told him to leave, he had refused, leading to some argument and the calling of police who arrived to find the younger man drinking alcohol which was in breach of his bail conditions, police prosecutor Tim Hutton said.

Taken to the watch house, the 29-year-old blew a breath/alcohol reading of 0.072 when he was subject to a zero level while on bail.

Having spent the night in the watch house, the man, who is not named due to domestic violence order provisions, pleaded guilty to breaching the order and his bail conditions.

His lawyer Peter Sloane told the court his client knew he was not to go to the home but he had been invited by his mother.

Mr Sloane described his client’s criminal history as “dreadful” and told the court he was subject to a four-month wholly suspended jail term.

Magistrate Kay Ryan noted there was no actual violence involved in the breach.

She sentenced the man to four months in jail but ordered he be released immediatel­y on parole.
