Delay for more details in court
A TOOWOOMA magistrate has given police 48 hours to get a statement from a witness and verify information before a bail application seeking to vary a condition can proceed.
The adjournment relates to a man’s application to vary a condition on his bail to allow him access to a workshop at a home.
The man is facing two counts of possessing child exploitation material and five counts of distributing child exploitation material.
The man cannot be named for legal reasons.
He appeared before the Toowoomba Magistrates Court yesterday with his solicitor seeking certain conditions be changed while the matter progresses through the courts.
Police objected to varying the condition which prohibits the man from having any contact with the children at the noted address.
However, in hearing the application, Magistrate Damian Carroll questioned why a statement was not taken from a witness around the time of the man’s arrest a month ago on the charges.
Mr Carroll adjourned the matter to tomorrow and ordered police take a statement from the witness.
He further ordered information regarding distances from a home to a shed be verified, and whether the man was able to continue working from a different location than his home address.
The application will go back before the Toowoomba Magistrates Court on Wednesday.
