Two front court on weapons charges
Confusion over their legal representation
CONFUSION about legal representation held up court proceedings yesterday morning for the father and grandfather of a Southern Downs boy who was accidentally shot in the face.
The boy’s father Roberto Gabriel Calvisi, 29, and Antonio Giovanni Calvisi, 63, both appeared at Warwick Magistrates Court.
Roberto Calvisi has been charged with one count of unlawful possession of weapons, whilst Antonio Calvisi has been charged with insecure storage of a weapon.
The pair initially faced Magistrate Bevan Manthey with Ian McLeod, who said he had “power of attorney” for the Calvisi family and would appear as a friend of the court.
But Mr Manthey asked Mr McLeod to remove himself from the bar table, as he had no legal credentials.
“I need full submissions to grant you leave,” Mr Manthey said.
The matter was then stood down for an hour, while the Cottonvale men sought advice from duty lawyer Clare Hine.
Dressed in a black t-shirt and jeans, Roberto Calvisi returned to the courtroom with Antonio Calvisi represented by Ms Hine about 10.30am.
“Both clients instructed they wish to withdraw their power of attorney and do not wish him to appear as friend of the court,” Ms Hine said.
“I will appear for them in this matter.”
Ms Hine moved to adjourn the cases so the men could seek legal advice and apply for legal aid.
The matter is scheduled to be mentioned at Warwick Magistrates Court on May 28, but the men are not required to attend.
