Methedup dad in ‘kill’ threat
A WARWICK father has walked free after a methfuelled rage where he threatened to kill strangers while brandishing a knife in a crowded pub.
Police were called to a disturbance at the Horse and Jockey Hotel Motel about 8pm on May 29, where they found Beau James Fogarty with a folding Stanley knife in the waistband of his pants.
Warwick Magistrates Court heard the 28-year-old said he’d been provoked by another patron and armed himself with the blade because he was outnumbered, but it wasn’t long before Fogarty started levelling threats of his own.
Police prosecutor Ken Wiggan said the Warwick man began yelling at other groups in the pub, shouting “I’ll kill every single f--king one of the last c--ts” and “if I’m going to get locked up for something, I might as well go to jail for murder”.
“They searched him to see if he had any other knives on him, as well as drugs based on his state (as) he was erratic,” Sergeant Wiggan said.
Police found 1.7g of ice and two glass pipes with drug residue in a bumbag around Fogarty’s chest.
The court was told Fogarty had Tourette syndrome and hadn’t taken his prescription medication in about a month, which contributed to his irate display at the pub.
Acting Magistrate Rob Turra sentenced Fogarty to nine months’ jail with immediate release on parole, warning that he was lucky his violent threats didn’t end with somebody getting hurt.
Fogarty pleaded guilty to one count each of possessing a knife in a public place, possessing dangerous drugs, possessing drug utensils, unlawful possession of a weapon, and contravening a probation order. He was also fined $300.
