‘Evil nature’ exposed

A MAN who was sentenced and jailed last year for attempting to kidnap the mother of his children has been sentenced again, this time for hacking into the same woman’s phone and distributi­ng intimate images of her on social media.

Brock Leslie Marshall was sentenced in Dalby District Court on November 23 last year for breaking into a home where he strangled, then attempted to abduct his ex-girlfriend and the mother of his children. He was sentenced to five and a half years jail, with a parole eligibilit­y date of June 30, 2023.

Police prosecutor Chris Hutchins said the 24-year-old who appeared in Dalby Magistrate­s Court on February 7 by video link had hacked into the woman’s social media just days before the abduction attempt on August 29, 2021 where he threatened to leak her private images.

“He hacked into her Facebook and was messaging her from her own account, calling her a s--t and said ‘I will send your naked photos to everyone you know’,” Sergeant Hutchins said.

The court was told the man published photos of the woman in her underwear on her own Facebook page with derogatory captions like ”I’m open for business”.

Sergeant Hutchins said the woman changed her passwords, however Marshall sent an email that read: “If you don’t make things right naked photos of you will be sent to everyone you know, I got you now you have until 12pm today”.

Police located the man at his Jimbour home later that afternoon where they discovered an extensive search history on his mobile that related to “how to hack someone’s Facebook account”.

The court was also told that days prior to the vengeful porn acts, Marshall called his former partner on her phone more than 100 times in less than 24 hours, asking her to pick him up from the hospital.

Sergeant Hutchins and defence lawyer Stuart Percy agreed in court that if the man had been sentenced for these charges while in District Court last year they believed there would’ve been no greater penalty.

“This is a horrible situation that arose over a short period of time,” Mr Percy said.

Magistrate Kyna Morice acknowledg­ed the acts were part of an ongoing incident that had just one day in between.

“You terrorised the aggrieved with threatenin­g behaviour,” she said.

“It was controllin­g and demeaning and is conduct the courts take incredibly seriously.”

Ms Morice acknowledg­ed the character references submitted by Mr Percy on Marshall’s behalf but said that despite the documents outlining the man’s “good character”, they were written by people who weren’t aware of what he was capable of.

“These references didn’t know of your violent and evil nature behind closed doors,” she said.

However, she told the court she was convinced that he would not have received a higher penalty if sentenced for these charges while in the District Court last year.

He is still eligible for parole on June 30, 2023 and was ordered to delete and destroy all intimate images of the woman within one month of being released from jail.
