Court told of murder allegation

A 30-YEAR-OLD man charged with murder arising from the death of Millmerran man Russell Klein has had his case mentioned for a second time before Toowoomba Magistrate­s Court.

Callum Anthony Padaric Cook has been held in custody since his arrest for the Christmas Day incident at Millmerran and was not in court for the mention of his matters but was represente­d by solicitor Nikola Prince of Legal Aid Queensland’s Toowoomba office.

Ms Prince told the court she had received a partial brief of evidence from police but there remained outstandin­g 13 witness statements and four exhibits. Ms Prince said some of the material would take “considerab­le time” to be completed and asked for a four-week adjournmen­t so she could go through the material already received with her client.

Police allege that after a disturbanc­e at a Commens St, Millmerran, property about 9pm on December 25, Mr Cook deliberate­ly drove his car into Mr Klein in the front yard of his own home.

The 55-year-old Darling Downs rugby league sustained critical injuries from which he died despite efforts of paramedics to revive him.

Police found Mr Cook at a nearby park a short time later, and he was arrested and taken into custody.

He has not as yet been called upon to enter pleas to the charges which include one count of murder as well as the unlawful possession of a weapon, ammunition and drug utensils, and unlicensed driving.

Ms Prince said it was hoped in the coming weeks to obtain “target dates” for the outstandin­g material from police.

Magistrate Louise Shephard therefore remanded Mr Cook in custody and adjourned the case for committal mention back in the same court on March 29.
