The remarks had left “a cloud over her head” and it was “very difficult to live with”.

Judge Rothman found no evidence that Cr Milne had been “shunned or avoided by the community at large” and noted she was re-elected to office.

“Neverthele­ss, the damage to the plaintiff is significan­t,” he said, acknowledg­ing Cr Milne had worked extremely hard for what she believed was the benefit of the community.

Mr Ell is reportedly worth $US1.3 billion and his Leda Group responsibl­e for the giant Cobaki estate near Gold Coast Airport. He also holds the Kings Forest estate site on the Tweed coast.

Both Mr Ell and Cr Milne did not return telephone calls this week for comment.
