Man walks free over partner assault

-

A GOLD Coast man who held his hands over his partner’s nose and mouth three times during a fight has walked from court after spending no time in prison.

Judge Catherine Muir sentenced the man, who legally cannot be named, to a head sentence of 12 months prison for the attack on June 5, 2016.

He was given an immediate parole release.

The man, 34, was subject to a domestic violence order at the time of the attack and also breached a suspended sentence he had been given a few months prior to the attack for assaulting the same partner.

He pleaded guilty to three counts of common assault.

The court heard the man and his partner began arguing about fuel money the morning after the woman, 44, had drunk a large amount of alcohol. During the argument, the assaults took place.

Ms Muir said according to the woman’s victim impact statement she and the man were still working together in his lawn mowing business and had a civil relationship for the sake of their young children.

The court heard the woman has no desire to rekindle an intimate relationship.
