Hayne ‘did not have sex with accuser’

HE’S been accused of rape but footballer Jarryd Hayne has denied having sex with the woman suing him in the US.

Court papers lodged by Hayne’s lawyer last week deny the allegation­s, saying the pair did not have sex after a night of heavy drinking in December 2015, and request her civil suit be dismissed.

The papers claim the woman, identified only as JV, “consented to all actions that took place, including all actions she now claims were non-consensual”.

Hayne’s response also states the woman – who claims to have been a virgin – followed the former San Francisco 49ers player from a Santa Clara bar and ordered an Uber to take them to his place, according to court documents.

‘The Plaintiff followed the Defendant out of a bar on the night of the alleged incident, ordered an Uber using the Defendant’s phone to take them both to where the Defendant was staying, and willingly engaged in sexual interactio­n that did not include sexual intercours­e,” say the papers.

According to Hayne’s response, the woman was “not injured at all”, and had a “cordial conversati­on” with a friend of his at his home the next morning.

He says JV headed home from his “apartment of her own volition, and did not report, show or claim any injuries to anyone after the alleged incident”. The woman filed her suit in December last year, alleging Hayne, 30, sexually assaulted her while she was “unable to consent” to sex.

“Mr Hayne brought our client back to his home, approached her in the dark, turned her around as to not face him and told her ‘no kissing’,” her lawyer John Clune said.

“He then nonconsens­ual sexual intercours­e with her, causing her significan­t physical pain.”

JV’s court papers claimed that when she woke the next morning she was “experienci­ng tremendous vaginal pain, she was naked had covered in a single sheet on a bed with a large pool of blood next to her”.

Her lawyers say the woman was too frightened to report the alleged assault for several months, but told police after receiving treatment for ongoing pain in April 2016.
