‘I wasn’t on drugs, I just needed lollies’

- LEA EMERY

A MAN allegedly caught speeding on a stolen motorbike in Surfers Paradise claims that instead of being high on drugs, he just needed jelly beans.

Andrew Rudd, 44, argues he is diabetic and when he was stopped by police in Monaco St about 9.45pm on Tuesday, he was suffering low blood sugar and was going to a service station to buy jelly beans.

The sweet excuse was not enough to convince Magistrate Donald MacKenzie to grant him bail yesterday.

Rudd, of Broadbeach Waters, faces multiple charges in Southport Magistrates Court including unlawful use of a motorcycle, driving under the influence and driving unlicensed.

Rudd’s lawyer Michael Gatenby, of Gatenby Lawyers, said the low blood sugar was why Rudd’s speech sounded slurred to police.

“He is diabetic and he was on his way to the service station to buy jelly beans,” he said.

Police are awaiting the results of blood tests to confirm if Rudd was under the influence of drugs.

Mr Gatenby told the court Rudd was not aware the bike was stolen because he had seen his friend, who lent him the motorcycle, ride it.

Mr MacKenzie said he was concerned about the number of unrelated matters Rudd had before the court. “You have a number of serious matters set down for sentence on April 30 which are likely to result in custodial time,” he said.

He denied Rudd bail and adjourned the matters to April 30.
