Family’s band of brawlers

TWO Tugun brothers and their father have escaped jail time after sparking a bar brawl at the Tugun Leagues Club which left a security guard with a footprint on his forehead and a scratched eyeball.

A pub patron who tried to break up the fight was bitten on the hand.

Toby Phillip Treveton, 27, and Rory William Treveton, 29, pleaded guilty in the Southport District Court yesterday to two counts each of assault occasionin­g bodily harm.

Their father, Phillip William Treveton, 53, pleaded guilty in the same court to two counts of common assault.

Judge Katherine McGinness sentenced the brothers to 15 months jail, suspended for two years. Phillip Treveton was placed on a $500 good behaviour bond for two years.

The men were also ordered to pay $2000 in compensati­on.

Crown prosecutor Michael Connelly described the fight as a “very ugly incident”.

“None of the defendants showed restraint or maturity,” he said.

Mr Connelly said the incident started after Rory punched Toby during an argument on the deck of the Tugun Leagues Club about 9pm on June 5, 2015. Mr Connelly said that when security guard Patrick Vargis approached the group, Toby Treveton punched him.

In a struggle between the men, Mr Vargis went over the rail of the deck and was punched. His eyes were gouged by Toby and his head was stomped on by Phillip.

Rory was grabbed by bystander Daniel McCall, who tried to stop the brawl. Rory bit his right hand. Mr McCall was then punched by Rory and kneed by Phillip.

Defence barrister Peter Nolan, for Toby Treveton, said the fight occurred just two weeks after Treveton’s best friend had committed suicide and six months after another friend had also taken their own life. He said the fight began over a disagreeme­nt about the cause of suicide.

Defence barrister Jason Buckland, for Rory Treveton, said his client was struggling with the tragedy.

Defence barrister Scott Lynch for Phillip Treveton said his client had not intended to step on Mr Vargis, but had done so trying to break up the fight between his sons.
