Cyclist who hit log sues council for $432k over injuries

A GOLD Coast man who hit a log and fell off his bike is suing the city for $432,000 claiming it affected his ability to do his job for the rest of his life.

Lane Alex Moore, 28, is claiming the damages from the Gold Coast City Council for his injury from the crash, court documents reveal.

The fall on August 22, 2016 dislocated his left shoulder and broke his arm, leaving him with permanent restrictio­n of motion in the left shoulder, pain and difficulti­es lying on his left side. He also has difficulty with forceful repetition above shoulder height, cramps and weakness in his left arm and shoulder.

“(Mr Moore) has and will continue to suffer for the next 38 years an impairment to his future earning capacity, by rea son of his personal injuries and ongoing symptoms and impairment,” the documents said.

The court documents detailed the fall happened in Bob Huth Park in Ashmore while the council was constructi­ng a wooden garrison fence at the entrance of the park.

One of the logs from the fencing was left hanging over on to the footpath. “As (Mr Moore) was exiting the premises the Plaintiff’s left food pedal came into contact with the log causing (Mr Moore) to fall from his bicycle and suffer an injury,” the documents said.

In the claim, Mr Moore says the council was negligent by not ensuring the footpath was clear of logs from the fencing.

A council spokeswoma­n declined to comment.

Mr Moore’s lawyer, the Qld Law Group, also declined to comment.
