No jail for man who had sex with 15-year-old girl and secretly filmed it

A GOLD Coast supermarke­t employee who had sex with a 15-year-old girl and filmed it without her consent will not spend a day in jail.

The videos were only found after Nicholas Elias Biazos, who was 21 at the time, threatened to release sexually explicit photos she had sent him when she was 14. The girl only found out about the videos when police showed them to her during their investigat­ions.

Biazos, now 24, pleaded guilty in the Southport District Court on Tuesday to three counts of carnal knowledge of a child and four counts of indecent treatment of a child.

Judge David Kent sentenced him to two years’ prison to be wholly suspended and placed him on two years’ probation. “Immediate custody is not necessary in your case,” he said.

Crown prosecutor Gary Churchill said the videos showed the pair in sexual situations and in some the girl was in her school uniform. “She had seen his phone but did not know it was being recorded,” he said. The court was told the pair met in 2016 and began a relationsh­ip. After the girl’s parents found out a mediation took place in July 2016. Biazos was told to stay away.

“In March 2017 they commenced an intimate relationsh­ip and he told her not to tell anyone,” Mr Churchill said.

Months later Biazos threatened to release the explicit photos if she did not do as he said. In March last year he was sentenced to seven months prison, wholly suspended, for the threats.

It was not until after that sentence Biazos was charged over the videos.

Mr Churchill said police knew about the videos before the sentence.

He said it was “operationa­l convenienc­e” that Biazos was not charged with the additional charges prior to the first sentence.

Judge Kent said he found that to be an “exceptiona­l circumstan­ce”, meaning Biazos did not have to do actual time in prison.

Defence barrister John McInnes said Biazos was remorseful for his actions.
