Choker had driven into victim’s home

A GOLD Coast man who choked his partner because he thought she was cheating on him was on bail for driving his car into her home a couple of months earlier.

Kristopher John Graham also tried to assault the woman a second time in a public toilet, but was stopped by a passer-by.

The 30-year-old pleaded guilty in the Southport District Court on Friday to multiple charges including choking, common assault and wilful damage.

Judge Michael Rackemann sentenced him to two years and nine months’ prison with immediate release on parole. Graham has spent 348 days in custody.

Crown prosecutor Mitch Whelan said that on October 24 the woman asked Graham to leave her alone.

March this year, he was sentenced to 12 months prison.

Graham first appeared in court for that incident on November 18 last year and was given bail.

That same night he went to her home and saw an open condom packet.

Mr Whelan said Graham became enraged, accused her of sleeping with other people and called her a slut.

Graham took her phone and stomped on it before throwing the woman on top of the bed, putting his hands around her neck and choking her.

As he left, Graham damaged a laptop and urinated on the woman’s clothing.

On November 30 last year, the couple were walking down the street and argued.

The women went to a public toilet because she was afraid Graham was going to assault her.

He followed her in and began banging on the cubicle door and cracked her phone screen. The woman walked out and tried to run away, but Graham forced her to the ground.

Graham was intoxicate­d for both incidents.

“She tried to scream out and a nearby resident intervened and called police,” Mr Whelan said.

Defence barrister John Fraser, instructed by Howden Saggers Lawyers, said Graham wanted a mental health plan when he was released.

“At least in my instructio­ns he would like to go to alcohol anonymous and really work on his alcohol abuse,” he said.

Mr Fraser said Graham had also made an appointmen­t with a psychologi­st.
