Court date days after bub’s death

Daley’s 13-month-old son Makavelii was raced to Cairns Hospital after he went into cardiac arrest about 9am on Monday, but he could not be revived.

Less than two weeks earlier, on September 12, police searched a car being driven by Daley after stopping it outside a Manunda home about 4am.

Sergeant Amy Rennie said the drugs and utensil were found in a handbag that Daley told police was hers.

Sgt Rennie told the court that Daley did not make any comment about the items to police. She has a limited history and no similar offending.

Magistrate Heggie said the amount of drugs was twice what was permissibl­e for a diversion program.

After speaking with Daley, Ms Hallam asked to vacate the guilty pleas and adjourn the matter after Magistrate Heggie indicated he would only be looking at a fine.

“Are there particular­ly pertinent reasons why the pleas should be vacated?” Magistrate Heggie asked.

“There are, subject to my instructio­ns,” Ms Hallam said, adding that Daley had entered the pleas on the basis that she could do the court diversion program.

Magistrate Heggie described the request as an “unusual circumstan­ce”.

“A person’s either guilty or not guilty,” he said.

Magistrate Heggie opted to leave Daley’s pleas on the record but adjourned the matter until next month.

Cairns detectives are waiting for forensic results to help determine the cause of death as they continue their investigat­ion into Makavelii’s death.
