Party host broke jaw of reveller, court told

A PARTY allegedly ended in a violent assault after the host kicked drunken friends and family off his property.

Jason Thomas Thimble is accused of breaking the jaw of Bjorn Lind by punching him three times in the face at a house party on Palm Island.

Thimble has pleaded not guilty to one charge of grievous bodily harm.

On the first day of his trial yesterday, the Townsville District Court heard Thimble was hosting an 18th birthday for his partner’s sister on May 9, 2015, which continued into the early hours of the morning.

Crown prosecutor Dane Marley said Mr Lind was at the party because his partner was also a sister of the woman celebratin­g her birthday.

The court heard Thimble was “going off” and told partygoers to “get the **** off my lawn” about 2am or 3am, which caused most to leave.

Mr Lind told the jury he had left to wake his partner up at her parents’ house nearby and returned with her to collect their young child, who was asleep at Thimble’s house.

He claimed to be talking to two women on the balcony of the house when without warning Thimble punched him three times from behind.

“He just walked up to the front door, spotted me and went one, two three and I fell to my knees,” Mr Lind said.

Defence barrister Clare Grant questioned Mr Lind on his drinking that night. He told her he was “drunk, but not that drunk”. He said he drank two beers on the ferry from Townsville, somewhere between half a bottle and a bottle of rum, “nips” of other people’s drinks and a few more beers throughout the evening.

Ms Grant put it to Mr Lind that he was trying to coax Thimble into a fight and he was slapped with an open hand and fell down some stairs with a bottle of rum in one hand and a glass in the other. He denied these suggestion­s.

The trial continues today.
