Forester, 41, was caught about 9pm on October 19 using THE woman who has accused Jarryd Hayne of rape in a California civil claim filed her initial complaint with police two weeks after he announced his plans to quit the San Francisco 49ers and leave the US.

The Bulletin can reveal that the woman, who has only been identified in court documents as Ms V, lodged the paperwork with San Jose Police Department on May 27 last year.

The District Attorney later decided not to lay charges due to insufficie­nt evidence.

A fortnight earlier, on May 15, Hayne announced that he was giving up his dream of playing in the NFL in an effort to achieve another goal of becoming an Olympian with Fiji’s rugby sevens side. However, he was not selected for the Rio Games. Ms V this week lodged a civil lawsuit seeking damages for the alleged rape. The burden of proof for a successful civil claim is lower than in the criminal courts.

Once Hayne is served with legal papers to answer her allegation­s it could still be about a year until the case is brought to trial.

In the court documents, the woman says she was raped by Hayne in the early hours of December 21, 2015, at his luxury apartment after a night out drinking with the Australian, her friends and his San Francisco 49ers teammates. a pair of scissors to cut the hose when police drove past on r patrols. Forester pleaded guilty in Southport Magistrate­s Court to possessing the drug.

However, there was deemed to be “insufficie­nt evidence” to charge Hayne with any crime.

The NRL star has categorica­lly denied raping the woman.

“Mr Hayne previously addressed a complaint made to the District Attorney’s office in the County of Santa Clara in 2016 and the District Attorney did not proceed any further with the matter due to insufficie­nt evidence to substantia­te the allegation­s,” his Sydney lawyer, Ramy Qutami, of Madison Marcus Law Firm, said.

“Mr Hayne has not been served with any proceeding­s or formal complaint relating to the incident. Mr Hayne unequivoca­lly and vehemently denies the allegation­s which are the subject of the civil complaint.”

Hayne is a devout Christian and was recently baptised in the Jordan River, before briefly returning to Australia for his daughter’s birthday. He went back to Israel this week after the rape allegation surfaced against him. police pulled him over in Southport about 11.30pm on Thursday. Magistrate Donald MacKenzie was surprised by Forester’s lengthy addiction.

“He should be dead by now with the addiction he has had,” Mr MacKenzie said.

The magistrate expressed surprise when defence lawyer Halley Robertson said Forester had expressed interest in getting help for his addiction.

“Do you really think that some 23-year-old social worker telling him not to take drugs will made a difference?” he said.

Mr MacKenzie said if the amount of drugs Forester had possessed was larger he would likely have faced jail time.

“Quite frankly it’s amazing he is still alive,” he said.

“What you need to do at 41 years of age is grow up.”

Forester was fined $400.
