Woman sues over surgery

A GOLD Coast woman is suing a surgeon for almost $500,000 after a procedure left her nose “dipping” and “falling away”, it is alleged in court documents.

Samantha Anable was forced to have a second procedure done by ear, nose and throat surgeon Mark Courtney two months later to fix the problem, according to documents filed in the Southport District Court.

It is alleged failed as well.

It is claimed in the court documents that Ms Anable had only undergone the surgery in an attempt to fix mouth ulcers. She is suing Dr Courtney for about $488,000 in damages she alleges she suffered because of the allegedly botched surgeries.

The court documents, filed

on her behalf by The Personal Injury Lawyers, claim that when the second surgery failed, Dr Courtney told Ms Anable he could give a third procedure “a go”.

Ms Anable was referred to another surgeon.

After the third surgery, Ms Anable’s mouth ulcers improved, it is claimed court documents.

It is alleged Ms Anable, 27, first went to Dr Courtney in May 2018 searching for a fix for recurring mouth ulcers.

Dr Courtney told her that her nose was on a slant.

“(Ms Anable) advised (Dr Courtney) to the effect she was happy with her nose aesthetica­lly, to which (Dr Courtney) responded to the effect that he does “many of these surgeries” and it was an “easy job” and a “bonus”, it is alleged in the court documents.

It is alleged Dr Courtney did not warn Ms Anable the surgery may not resolve mouth ulcers, result in deformity of her nose and she in the might be unhappy with aesthetic appearance.

The surgery was performed on August 20, 2018.

Ms Anable alleges she went back to Dr Courtney on September 20, 2018, and “expressed concern that her nose appeared to be dipping and falling away”.

It is alleged Dr Courtney told her to tape her nose.

Ms Anable alleges she went back to Dr Courtney on October 2, 2018, and surgery was recommende­d, including a rib graft to fix the nose. The surgery was performed on October 4, 2018, but Dr Courtney took a graft from Ms Anable’s ear, it is alleged.

Courtney in November 2018, when he allegedly told her he could give a third surgery “a go”. She was referred to another surgeon and had a successful surgery in April 2019, it is claimed.

Ms Anable alleges Dr Courtney failed to advise her of all the risks of surgery, failed to take reasonable steps to ensure her safety and failed to meet standards of care.

She also claims the surgery was “not rendered with due care and skill, reasonably fit for purpose and of such nature, quality, state and condition as to be reasonably fit for their intended purpose”.

Dr Courtney is yet to file a defence.
