Man to pay Dhs44,000 for using friend’s credit card

ABU DHABI: Al Ain Court of First Instance obligated a man to pay his friend Dhs44,000, ater the friend filed a lawsuit demanding that he pay Dhs58,000 because the appellee used his credit card, and borrowed Dhs10,000 from it.

In his lawsuit, the complainan­t also demanded that the appellee be obligated to pay the fees and expenses of the case, indicating that his friend used the card in bad faith, which resulted in debts amounting to Dhs48,000 with the interest due on the card, besides withdrawin­g Dhs10,000 in cash, and then refused to return them.

The judge delegated an accounting expert, who explained that the complainan­t obtained the card with a credit limit of Dhs25,000 and an annual interest rate of 3.5 per cent.

The complainan­t presented two witnesses who testified that he had the credit card so that his friend could benefit from it in the purchase and it was in the appelle’s possession who already used it.

Whatsapp messages between the two parties proved that the card was in the possession of the appellee and he was the one using it. The expert indicated that the debt on the card amounted to Dhs34,000, of which the complainan­t paid Dhs32,000.

Ater receiving the expert’s report, the complainan­t demanded that the appellee be obligated to pay him Dhs44,000, along with the fees, expenses, and lawyer’s fees. The court decided to make the complainan­t swear, and then decided that the appellee owed Dhs34,000 in addition to the Dhs10,000 to the complainan­t, which he received from him as a loan, and then obligated the appellee to pay Dhs44,000 in addition to paying the appropriat­e part of the expenses.

Recently, the Abu Dhabi Court for Family and Civil and Administra­tive Cases obligated a father to pay his daughter Dhs5,000 in compensati­on for the material and moral damages incurred by her ater he assaulted her and causing her injuries.

The appellee’s two daughters and his granddaugh­ter filed a lawsuit in which they demanded that he pay them Dhs49,000 in compensati­on ater he assaulted them, in addition to obligating him to pay the fees and expenses of the lawsuit and the lawyer’s fees.
