ABU DHABI: The Abu Dhabi Court for Family, Civil and Administrative Cases obligated a woman to return Dhs100,000 to another, who borrowed the amount as a debt, but refused to return it.

The details date back to the time when a woman filed a lawsuit against another in which she requested that she be obligated to return Dhs100,000, as well as to obligate her to pay the fees and expenses of the lawsuit and the lawyer’s fees.

The plaintiff said that the appellee asked her for Dhs100,000 as a debt, but she refrained to return the amount when she was asked to.

The plaintiff atended the session with three witnesses, where the first swore that the appellee owed the plaintiff Dhs100,000, which the former took and did not return.

The second witness stated that the appellee admited before her that she took Dhs100,000 from the plaintiff as a debt and did not pay anything back, adding that she issued a cheque of the amount.

The third witness stated that because there were disputes between the two sides of the case, he brought everyone to his house to solve them, and during that time the appellee admited to them that she had taken Dhs100,000 from the plaintiff, a debt which she did not return.

The court explained that the case papers proved that the cheque the appellee issued was proved in the statement of the appellee’s account provided by the bank, adding that she did not atend the sessions to present her defence and exonerate herself, and then the court saw that she owed Dhs100,000 to the plaintiff and obligated her to return it.

Recently, the Abu Dhabi Court for Family and Civil and Administrative Cases rejected a lawsuit filed by an employee of a company in which he demanded to obligate his colleague to pay him Dhs570,000, and a delay interest of 12% from the date of the claim until full payment.

He also asked the court to view the Whatsapp chats between them and get the appellee to swear that he did not get the amount claimed from him.
