COURT TO SET TRIAL DATE FOR MONTSHIWA’S MURDER CASE

The trial date in a case which attorney, David Modise, is accused of the murder of his client, Michael Montshiwa, in 2015, will be decided by a Gaborone High Court next month.

The main suspect, Modise, and his traditiona­l doctor co-accused, Tumelo Tshukudu, will appear for mention at the Gaborone High Court on the 3rd of August.

The 35-year-old lawyer is linked to the death of his client, Montshiwa, and is facing another charge of stealing by agent.

David is alleged to have been the last person to communicat­e with Montshiwa, just 28 minutes before the Fair Grounds Chief Executive Officer was shot dead on the 18th of October, 2015 at his house in Block 6, Gaborone.

The rifle, which was used to kill Montshiwa - it is alleged - had been bought by Modise from one Bampoloki Seeiso with the help of Tshukudu.

Prior to the buying of the rifle, Tshukudu and David reportedly travelled to Mahikeng in South Africa in an effort to buy a pistol for David’s self-protection.

It is alleged they failed as the person whom they wanted to buy the gun from did not show up.

Allegation­s are that Tshukudu then advised David to buy a rifle from Seeiso for P2 500.

The rifle was allegedly delivered on October 17th prior to the day that Montshiwa was killed.

Investigat­ing Officer, Detective Sergeant Marapo, previously told court that investigat­ions revealed that Modise was the last person to talk to the deceased.

He said investigat­ions revealed that between June 30th and

October 17th, 2015, Modise withdrew about P245 000 from Montshiwa’s Trust account.

Detective Marapo said the money was entrusted to Modise for the purchase of a plot for Montshiwa in Mogoditsha­ne.

“Montshiwa realised that the money was missing from the Trust account and he communicat­ed with Modise demanding to see him at his house on the night he was killed. The investigat­ing team went to Zimbabwe in 2018 to further their investigat­ions and got some evidence which links some of the exhibit to how the deceased was killed. Prosecutio­n is done studying some exhibits, which were gathered through the Mutual Legal Assistance from Zimbabwe and ready for trial. The investigat­ing team has managed to verify some exhibits which are central to some evidence which will be used in court during trial,” he told court.

The State is expected to call more than 30 witnesses in the matter. Modise is out on conditiona­l bail awaiting trial.
