Authoritie­s search for K Cham man after he skips court date twice

RATANAKKIR­I provincial police have yet to arrest Thy Rithy Sei, who was charged under Article 391 of the Criminal Code for “breach of trust” and failure to appear in court on October 17.

Authoritie­s said Rithy Sei ignored an arrest warrant issued by Investigat­ing Judge Leng Vannarith of the provincial court.

The warrant said: “The suspect was ordered twice to appear in court, but he has not appeared to testify.

“According to ABA Bank, [the suspect] used a blank cheque [believed to have been issued by ABA Bank]. To facilitate a thorough investigat­ion, an arrest warrant must be issued for the charged person.”

Rithy Sei, 32, had committed the offence on June 29, last year, at Boeung Kanseng commune, Banlung town, in Ratanakkir­i province.

The warrant said the court had decided to order competent agents from all levels to arrest Rithy Sei, a taxi driver from Kampong Siem district’s Ro-ang commune in Kampong Cham province.

The court also ordered Ratanakkir­i Provincial Prison to receive Rithy Sei until a new order is given which directs them otherwise.

Article 391 defines “breach of trust” as having been committed when a person “to the prejudice of other persons misappropr­iates funds, valuables or any property that was handed over to him or her and that he or she accepted subject to the condition of returning, redeliveri­ng, presenting or using them in a specified way”.

Judge Vannarith told The Post on Sunday: “Until now, I am yet to see the police arrest the charged person. I issued the arrest warrant, while the prosecutor requested for it.”

Ratanakkir­i provincial police chief Yin Chamnan told The Post on Sunday that he is yet to receive the arrest warrant for the suspect.

“Maybe, the court sends [the arrest warrant] to the police in the location near where the suspect lives. But I have not yet received any report over the arrest of the suspect,” he said.

Kampong Siem district police chief Ek Van Dorn said he too had not received an arrest warrant for the charged person, adding he would contact specialist­s for informatio­n.
