Middleton man handed conditiona­l sentence for Kingston break and enter

A Middleton man will serve a conditiona­l sentence with a daily curfew for breaking and entering a home with intent to commit an indictable offence and other charges.

Scott Anthony Melanson, 44, was also charged with failing to leave a premises after being directed to leave, contrary to the Protection of Property Act; failing to attend court; and failing to comply with his recognizan­ce.

Melanson pleaded guilty to the break and enter and the Protection of Property Act charges on Aug. 20. The matters were adjourned to Oct. 20 to allow time for a presentenc­e report to be prepared.

Melanson was not present for court on Jan. 6 and the court heard that there was no report prepared. The defence lawyer also had no instructio­ns from Melanson. A warrant was authorized but not endorsed for failure to attend.

The accused was present in Kentville provincial court, in custody, on Jan. 15. Melanson pleaded guilty to the two charges of failing to attend court. Judge Claudine MacDonald handed Melanson a total 90-day conditiona­l sentence order with daily curfew from 9 p.m. to 6 a.m. for the entire time in relation to the break and enter charge and the two charges of failing to attend court. This will be followed by 12 months of probation.

Melanson was also fined $300 in victim surcharges on the three counts and $100 on the Protection of Property Act charge.

Melanson committed the offences in Kingston on Nov. 6 and in Middleton on Nov. 27, 2013, and in Annapolis Royal on Jan. 6 and April 7, 2014.
