Accused grandson killers seeking bail

Couple facing manslaught­er charges in 2015 death of five-year-old boy

The Calgary couple charged with manslaught­er in the death of their grandson last year should be released on bail, their lawyers said.

Defence counsel Brendan Miller and Darren Mahoney said Monday they want the Crown to provide disclosure as soon as possible so they can try to get their clients out of jail.

Allan Edgardo Perdomo Lopez, 56, and Carolina Del Carmen Perdomo, 49, made a brief first appearance in provincial court on a charge of manslaught­er in connection with the death of Eneas Emilio Perdomo.

The five-year-old boy was taken to the Alberta Children’s Hospital on July 10, 2015, suffering from injuries family members attributed to numerous accidents, police said when the couple was charged last week.

But medical staff, which observed swelling and bruising all over his body, concluded the injuries were not consistent with activities of a child that age, police said.

The boy died a week after his admission and an autopsy concluded he died of multiple blunt-force trauma injuries.

Mahoney and Miller said they have received no informatio­n from Crown prosecutor Vicki Faulkner about the allegation­s against their clients.

“The Crown has advised they’ll be seeking detention,” Miller said outside court.

“Our position is we can’t make that (Crown) applicatio­n and defend that applicatio­n without disclosure,” he said.

Mahoney said if the prosecutio­n can’t come up with reasons why the couple should remain behind bars they should be released.

“We’ve been provided nothing to say why they should be held on any kind of grounds,” he said.

“We would basically like the Crown to make their case as soon as possible on why they want our clients detained and if not we’d like them released,” Mahoney said.

Mahoney said if the prosecutio­n doesn’t provide disclosure before Thursday, when the couple returns to court, he’ll oppose any further delay in a bail hearing and ask for their release.

“If the Crown can’t provide any evidence on Thursday as to why our clients should be detained, I’ll be asking the court to release them.”

Judge Mark Tyndale rejected a bid by Faulkner for an order prohibitin­g the two from being in contact, noting they’ve had a year to concoct a story if that was their intent.
