Cape Breton man accused of having contact with victim of sexual assault
An additional offence was filed Wednesday against a Cape Breton man charged with breaching a recognizance by having contact with the victim of a sexual assault.
Jeffrey Daniel MacIntyre, 26, formerly of North Sydney, is now facing four counts of breach in connection with the recognizance signed Nov. 8 after he was released from a federal prison. He is alleged to have breached Nov. 10.
The recognizance was issued after MacIntyre served his entire 29-month sentence after pleading guilty to two counts of luring a child under 16 for a sexual purpose; two counts of breaching court orders; two counts of possession of child pornography; extortion; single counts of sexual assault and committing an indecent act.
The recognizance was to be in place for two years but the Crown has now served notice it wants to revoke the release.
After a brief provincial court appearance Wednesday, MacIntyre consented to remain in jail pending his next court appearance set for Nov. 29.
He is now charged with four breaches of the recognizance. He is alleged to have possessed a device capable of accessing the internet, failing to keep the peace and be of good behaviour, failing to not have contact with anyone under the age of 16 and failing not to have contact with the victim of the sexual assault for which he was sent to prison.
At the time of the offence, the female victim was only 13. She and MacIntyre had engaged in sexual intercourse after communicating online. MacIntyre had told the girl he was 16, when in fact he was 22.
In July, the National Parole Board revoked MacIntyre’s statutory release after he was found in possession of a cellphone through which he accessed the internet, including pornographic websites, in breach of his special release conditions.
In August, just prior to his second statutory release, the Correctional Service of Canada found a notebook in MacIntyre’s cell containing drawings of pornographic images of young females and crude, descriptive letters written by him.
