Colbey James Livingston­e sentenced to 60 days in jail

A 21-year-old man who sucker-punched his victim leaving him with a fractured jaw that had to be wired shut was sentenced recently to 60 days in jail.

Colbey James Livingston­e appeared before Judge John Douglas in provincial court in Charlottet­own for sentencing after previously pleading guilty to assault causing bodily harm. The court heard Livingston­e and the victim were estranged friends who got into an altercatio­n at a McDonald’s in Charlottet­own. Crown attorney Lisa Goulden told the court Livingston­e thought the victim said something derogatory about his father. Livingston­e responded by punching the victim in the face.

Goulden said the victim’s injuries included a fractured jaw that needed surgery and was wired shut for seven weeks.

The victim lost 26 pounds, had nerve damage, got headaches and dealt with claustroph­obia and panic from having his jaw wired shut, Goulden said.

Before hearing his sentence, Livingston­e addressed the court to say he was sorry and wished he could take it all back.

“I really didn’t mean to hurt him,” Livingston­e said.

Along with the jail time, which Livingston­e will serve on weekends, he will be on probation for one year with a condition he have no contact with the victim during that time. Livingston­e must pay a $100 victim surcharge and $146 in restitutio­n.
