Prelim hearing set for sex assault case

A 31-year-old Lethbridge man accused of sexually assaulting two young boys earlier this year has elected to be tried by a Court of Queen’s Bench judge.

Cody Tyler Black Forehead also chose Friday during a hearing in provincial court to have a preliminar­y hearing, which will be heard Jan. 15, 2018. A preliminar­y hearing is normally held to determine whether there is enough evidence to warrant a trial.

Black Forehead is charged with two counts of sexual assault, two counts of sexual interferen­ce and one count of invitation to sexual touching.

On April 28 police responded to a report of a sexual assault that had occurred during the night at a man’s home.

Police determined two 15-year-old boys had sneaked out of their homes late in the evening on April 27 and met up with a man one of the boys met on a social media site.

Police said the boys consumed liquor and drugs at the man's home during the night and were sexually assaulted. A suspect was arrested without incident three days later.

Black Forehead was released from custody May 11 on $2,000 no-cash bail and conditions that he not have any contact with anyone under the age of 18 unless he’s with another adult. He’s not to log onto any social media websites for the purpose of communicat­ing with anyone under the age of 18, and he is prohibited from consuming alcohol and nonprescri­bed drugs.
