The witness officer told investigators as McIntyre approached, he could see his eyes and decided to pepper-spray him, thinking it would “defuse the threat right there, and he would most likely go on his knees, and then we can proceed to take the knife away from him.”
Instead, it enraged McIntyre. He yelled “you f--ker,” and charged at the officer, he told investigators. The witness officer took cover and saw McIntyre change focus to his partner.
The witness officer then “heard a pop” and saw McIntyre drop.
“The guy was still looking to put up a fight, even though he’s been shot,” the witness officer said. He saw another knife in McIntyre’s back pocket and retrieved, then handcuffed him, he said.
A civilian witness told investigators that McIntyre did not immediately fall. He took a couple of steps back, still in a “defiant stance … He finally crumpled alongside a post.”
The subject officer, the one who fired the fatal shot, declined to be interviewed by the IIO.
“It does not appear that the subject officer has completed any reports or notes of his recollection of the incident. The IIO has, and continues to engage with the RCMP on the necessity of officers completing timely reports.”
The probe focused on whether the officer was legally justified in shooting McIntyre. The IIO concluded police “were confronted with threatening and potentially deadly assaultive acts involving a non-trivial weapon. The threat was undeniably real and imminent.”
Last year, in an interview with the National Post, a spokesman for the Anonymous crew who ran the leaks campaign said they would retaliate if the shooting was covered up.
“We will sniff out your dirtiest laundry, procure it from wherever it’s hiding and find the highest flagpole in the windiest part of the public square and hang it up for everyone to smell and everyone to see,” he said.
