No bail for man charged as accessory to fatal stabbing
It’s not safe to release Estevan Andres Fuenzalida from custody while he awaits trial on being an accessory after the fact to murder, a Saskatoon judge decided.
Justice Mona Dovell issued her decision Wednesday morning denying bail to Fuenzalida, after his bail hearing was conducted Tuesday afternoon in Saskatoon Court of Queen’s Bench.
Fuenzalida, 24, is charged with being an accessory after the fact to the second-degree murder of Dustin Boulet on March 1, after Boulet was stabbed outside a bar on the city’s west side.
It’s alleged Fuenzalida helped the man charged with second-degree murder, 27-year-old Nathan Joseph, escape.
Fuenzalida is also charged with being an accessory after the fact to two counts of aggravated assault and with possessing a weapon for a dangerous purpose. Joseph is charged with aggravated assaults against two other men.
In a four-page written decision, Dovell said she wasn’t satisfied “that any stringent conditions would be available to ensure the safety of the community or that the administration of justice might not be interfered with” if Fuenzalida was released.
Even though Fuenzalida’s parents offered to put up to $10,000 in bail and allow him to live with them, Dovell said she was concerned Fuenzalida “might take advantage of their good nature and intentions.”
Evidence presented at the bail hearing is subject to a publication ban. Friends and family of Boulet have said he was stabbed after a man pulled a knife on his friend and Boulet stepped in between the two. Boulet died in hospital later that morning.
Fuenzalida is due back in Saskatoon provincial court on April 17. Joseph, who has not applied for bail, returns to court March 31.
