Maxi hit by meaty class-action suit
The lawsuit was filed in Montreal on Thursday, but must still be approved by a judge before it can proceed.
The suit, which also names Loblaws and Provigo Distribution disputes the validity of the "WHOLESALE / Save 25 per cent" advertising in Maxi & Maxi & Cie stores in Quebec and the real savings customers who bought this format enjoyed.
The application alleges false advertising and misrepresentation contrary to the Consumer Protection Act and demands that each consumer be compensated for the difference between the price paid and the price that should have been charged, in addition to punitive damages.
Pending the decision of the Superior Court on the authorization suit, lawyers recommend holding on to proofs of purchase of "GROS format" meats from Maxi and Maxi & Cie.
