Public feedback sought during review of trespass legislatio­n

The public has until October 1 to provide their feedback on a review of Saskatchew­an’s trespass related legislatio­n.

The provincial government is conducting the review to see if changes are warranted to existing legislatio­n. In particular, the survey asks: - Should Saskatchew­an legislatio­n provide that all access by members of the public to rural property requires the prior express permission of the rural land owner or occupier regardless of the activity and failure to secure that consent constitute­s an offence?

- If so, how should such permission be sought and granted?

Additional questions include:

Should all access by members of the public to rural property require the express advance permission of the rural land owner regardless of the activity?

Should there be a distinctio­n between cultivated land, fenced property and open pasture land or should all land being used for agricultur­al purposes be treated the same?

How should permission be sought and granted?

Would making consent an express prerequisi­te in all circumstan­ces represent an unreasonab­le impediment to recreation­al activities?
