Public feedback sought during review of trespass legislation
The public has until October 1 to provide their feedback on a review of Saskatchewan’s trespass related legislation.
The provincial government is conducting the review to see if changes are warranted to existing legislation. In particular, the survey asks: - Should Saskatchewan legislation provide that all access by members of the public to rural property requires the prior express permission of the rural land owner or occupier regardless of the activity and failure to secure that consent constitutes an offence?
- If so, how should such permission be sought and granted?
Additional questions include:
Should all access by members of the public to rural property require the express advance permission of the rural land owner regardless of the activity?
Should there be a distinction between cultivated land, fenced property and open pasture land or should all land being used for agricultural purposes be treated the same?
How should permission be sought and granted?
Would making consent an express prerequisite in all circumstances represent an unreasonable impediment to recreational activities?
