Speeder charged with breath re­fusal

A Monc­ton man who was al­legedly driv­ing more than 40 km/h over the speed limit has been charged with re­fus­ing a breath de­mand.

On Jan. 21, the RCMP in Corn­wall al­legedly caught the 35-year-old man driv­ing more than 100 km/h in a 60 km/h zone in a res­i­den­tial part of Corn­wall.

The RCMP said the driver showed signs of al­co­hol con­sump­tion and when of­fi­cers de­manded breath sam­ples for a road­side screen­ing he re­fused. His reg­is­tra­tion was also ex­pired at the time.

Re­fus­ing to pro­vide a breath sam­ple car­ries the same penal­ties as im­paired driv­ing.

The RCMP re­ported it was snow­ing and vis­i­bil­ity was lim­ited at the time.

The driver will ap­pear in pro­vin­cial court in March.
