A friend of a man on trial for first-degree murder says he heard the accused say he would kill the victim after she broke the windshield on his truck and kicked out its taillights.
That testimony came during the third day of Joel Lawrence Clow’s trial in P.E.I. Supreme Court in Charlottetown.
During the friend’s testimony, the court heard he was at Clow’s home in Pleasant Grove when he saw Traci Lynch damage the truck because Clow wouldn’t drive her in to town.
“I’ll kill that bitch some day,” he testified Clow said to him after Lynch damaged the truck.
The witness later said Clow’s response was just a figure of speech.
Clow is on trial after pleading not guilty to first-degree murder in the death of Lynch on July 24, 2015.
A statement of admissions presented in court said Clow acknowledged his physical acts must be responsible for Lynch’s unlawful death.
The witness testified he never saw Clow get physical with Lynch.
“No way in hell.”
The trial came to a sudden stop Wednesday morning after a friend of Lynch’s, who was on the stand, had an epileptic seizure while giving testimony.
Before the woman took the stand, Crown attorney Cyndria Wedge warned the court the witness had epilepsy and was concerned about the possibility of having a seizure.
Sheriffs and police officers in the courtroom rushed to the woman’s aid after she alerted the court she felt a seizure coming on.
The courtroom was cleared, and the trial recessed until the afternoon.
After the trial resumed, Wedge said the woman was taken to the Queen Elizabeth Hospital, but it was unclear at that time if she would be able to resume her testimony.
While the witness was on the stand, the trial was in a voir dire to determine if some of her evidence would be admissible.
During her testimony, the woman said Lynch told her several times she was scared of Clow.
In one text message read in court from Lynch to the woman, the victim said Clow had tried to run her down and flooded her house.
Three other friends of Lynch’s testified the woman told them she was scared of Clow.
Their evidence was also given while in a voir dire.
The court heard from multiple witnesses that Lynch told them Clow dumped bleach over her clothes ruining them.
In one case, a witness testified Lynch stayed with him and his then girlfriend overnight a few days before she died because she didn’t feel safe.
Clow’s son also testified Wednesday and said he saw Lynch snort drugs a couple of times a week.
He described Lynch to the police as “a snowball headed to hell” and said in court he meant she was going downhill because of drugs.
Several other witnesses who testified Wednesday also said Lynch used drugs, including speed and Percocet, although their accounts of how heavy her drug use was varied.
The trial resumes today.
