Charlottetown Airport faces lawsuits from two stumbles two years ago
Two people are suing the Charlottetown Airport Authority for damages alleged to have resulted from them falling on icy surfaces in separate incidents two years ago.
The two incidents occurred in December 2015 less than two weeks apart.
Stephanie Carlene Ebsworth, in a statement of claim filed in the Supreme Court of P.E.I. last month, alleges she suffered personal injuries and damages, including a fractured ankle after falling on ice and snow as she was walking along the tarmac to the airport terminal.
Ebsworth charges the airport authority failed to prevent passengers from accessing the airport “without remediating any hazardous conditions.”
She is seeking damages for injuries “that are physical and psychological in nature.’’
She claims to have sustained pain and suffering, loss of enjoyment of life and loss of amenities and is unable to participate in recreational, social, household, athletic, employment, school and activities of daily living to the extent that she participated before the incident.
The Charlottetown Airport Authority has until Dec. 20 to prepare a statement of defence.
Doug Newson, CEO of the airport authority, would not comment on the suits specifically but noted safety of passengers and employees is taken “very seriously.’’
Danny W. Penny filed the second suit against the Charlottetown Airport Authority.
Penny claims he slipped on an icy portion of the airport’s parking lot on Dec. 16, 2015, and fell heavily on the pavement.
He alleges the fall resulted in a torn right rotator cuff and an injured right elbow.
The airport authority is accused of failing to keep the parking lot free of ice and in a safe condition for pedestrian traffic.
“The plaintiff has, as a result of the defendant’s negligence, endured pain and suffering, loss of enjoyment of life, a reduced capacity to care for himself and perform household chores, participate in hobbies and recreational activities,’’ the statement of claim reads.
The Charlottetown Airport Authority has until Dec. 19 to prepare a statement of defence.
